HC junks CIC order on PM’s degrees, fines Kejriwal Rs 25k
The Gujarat high court on Friday quashed a seven-year-old order of the chief information commissioner (CIC), directing Gujarat University to provide information sought by Delhi CM Arvind Kejriwal on PM Narendra Modi‘s postgraduate degree under the RTI Act.
Justice Biren Vaishnav, who was hearing the university’s plea challenging the CIC’s “suo motu order”, fined Kejriwal Rs 25,000 for “making a mockery of the very intent and purpose of the RTI Act”. The Delhi CM is required to deposit the penalty with the Gujarat State Legal Services Authority within four weeks.
“There has been indiscriminate misuse of the salutary provisions of the RTI Act in the present case for purposes not contemplated by the legislature while enacting the said Act,” the court said.

Questioning the propriety of then CIC Sridhar Acharyulu’s order to Gujarat University, the court said a quasi-judicial forum like the information commission ought not to assume suo motu authority. “The commission transgressed its jurisdiction… and ventured into judicial activism on being overwhelmed by the fact that the information (on the PM’s degree) is sought by a citizen occupying the post of chief minister, and thus is liable to be disclosed.”
The court felt that disclosure of PM Modi’s postgraduate degree could not be considered a matter of public interest. “Extraneous considerations have gone into the decision-making process,” it said of the CIC’s order.
Justice Vaishnav noted that Gujarat University had already posted PM Modi’s MA degree on its website, about which Kejriwal was aware. Kejriwal later tweeted in Hindi, “Doesn’t the country even have the right to know how much the PM has studied?
BJP: Kejriwal peddling lies against PM
BJP on Friday attacked Delhi chief minister Arvind Kejriwal and accused him of “peddling lies” against Prime Minister Narendra Modi after the Gujarat high court set aside the Central Information Commission’s order asking Gujarat University to provide information on Modi’s degree to him.
BJP also cited instances of the AAP chief apologising to its leaders for levelling “unverified” allegations, saying “history is repeating itself”.
In a statement, BJP spokesperson Sambit Patra said, “What Kejriwal is doing reflects his frustration. He is naturally frustrated as his government ministers are in jail on charges of corruption and being involved in a liquor scam. His comments are a consequence of this.”
